Riding all-terrain vehicles is a popular pastime for many Arizonans, sometimes starting at a very young age. ATV riders are exposed to the same dangers as motorcycle riders; not being seen by other drivers can lead to deadly Arizona ATV accidents, and not wearing a helmet can lead to very serious injuries that may have been prevented.
Two teens, a male aged 16 and a female aged 15 were thrown off their ATV while riding on the road in Phoenix, most likely due to a car cutting them off (AZ Family 10/23/10). Both were transported to the hospital with serious head injuries as neither wore a helmet.
While helmets can help save lives and can prevent serious head injuries, they are not required to be worn while riding an ATV or motorcycle in Arizona. However, motorcyclists who suffer injuries that could have been prevented if he or she wore a helmet may receive less compensation. The unwritten Arizona “Helmet Law” means riders are punished if they don’t wear a helmet, even though it is not required by law.
