Bus Accident

Seven Injured in Phoenix Bus Accident

Seven people were hospitalized following a Phoenix car accident involving a Toyota Corolla, a minivan and a Valley Metro Bus. According to AZFamily.com, the bus accident occurred on Thomas Road west of 83rd Avenue in Phoenix. The report states the driver of the Corolla made an unsafe lane change and sideswiped a minivan carrying seven people. The van subsequently crashed into a Metro bus, which was directed into a utility pole. All seven occupants of the minivan were hospitalized following the crash though none appeared to have suffered a serious injury. The 66-year-old driver of the Corolla left the scene of the crash but was later arrested by the authorities.

Many Arizona car accidents involve a driver making an unsafe lane change. Arizona Revised Statute states: “A person shall drive a vehicle as nearly as practicable entirely within a single lane and shall not move the vehicle from that lane until the driver has first ascertained that the movement can be made with safety.” Making a lane change without yielding the right-of-way of looking for other motorists can put everyone on the roadway at great risk.

Injured victims of Phoenix car or bus accidents may seek financial compensation for the damages they have suffered by filing a personal injury claim. At-fault drivers may be held liable for losses such as medical bills, past and future suffering and time away from work.

Bus Companies’ Duty of Care to Arizona Bus Passengers

Common carriers are mass transit companies that transport passengers in taxi cabs, buses, trains and airplanes. All common carriers are legally obligated to provide the highest duty of care to ensure that their passengers arrive at their destination safely. This duty of care requires all common carriers to regularly maintain their vehicles, to hire skilled and qualified drivers and to warn passengers of any potential dangers. When a bus company fails to obey this duty of care, they may be held liable for the injuries and damages caused.

Determining liability for an Arizona bus crash can be a complicated process. A few examples of potential liable parties include the bus company, manufacturer and driver. Negligent bus drivers may be held liable for the accidents they cause. When the bus driver has a history of negligent driving, the bus company may be held liable for hiring that driver in the first place. For example, common carriers are required to test drivers for alcohol and drug use. The bus manufacturer may be held liable for a crash if it is caused by a defective bus part or design.

Holding a bus company liable for injuries suffered in an Arizona bus accident may be a complicated process. Despite being held to a higher duty of care to passengers, many bus companies use powerful insurance companies that dispute claims and refuse to make adequate payments to injured victims.

The Phoenix bus accident attorneys at Breyer Law Offices P.C. help injured victims of Arizona bus crashes receive fair and full compensation for all their losses. 4 Injured in an SUV-School Bus Collision in Surprise, Arizona

Statistics from the National Highway Traffic Safety Administration (NHTSA) show that every 10 seconds, someone is involved in a car accident in the U.S. In 2009, nearly 34,000 people died and millions more were injured because of car accidents (NHTSA, Fatality Analysis Reporting System). Research shows it is also the leading cause of death among teens.

A primary factor contributing to a car crash in many cases is drunk driving. Did you know that every minute, a person is injured from an alcohol-related crash (Mothers Against Drunk Driving 2010)? It is also the leading cause of death among teens–one out of the three teen fatalities is alcohol-related.

At about 6:55 a.m. on Monday, four people were taken to a local hospital after a Jeep collided with Dysart School District school bus in Surprise (AZ Central 11/29/10). A 15-year-old student and two school employees were aboard the bus when the SUV crashed into it head-on. The driver of the SUV acquired serious injuries and was taken to the hospital, while the three passengers of the school bus only had some minor injuries and were all taken to a local hospital. The cause of the Arizona bus accident is still under investigation.

Knowing that traffic accidents are the leading cause of death for people ages 1 to 34, it is always important to know and implement safety measures for yourself and your loved ones. The simple act of buckling up can make a huge difference: about 88 percent of all drivers and passengers do so regularly (National Safety Council 2010). In an accident, safety belts can reduce the risk of injury by up to 50 percent!

Although traffic fatalities in Arizona were reduced by 14 percent from 2008 to 2009, many are still seeking for justice for the injuries they suffered because of Arizona car crashes (NHTSA, FARS). If you are one seeking legal assistance from our Arizona car accident attorneys, call the Breyer Law Offices P.C. today at 480-753-4534 for free consultation.

Three Passengers Suffer Smoke Inhalation in Arizona Greyhound Bus Accident

Three people were treated for smoke inhalation after the Greyhound bus in which they were passengers caught fire on a southern Arizona freeway while headed to Los Angeles from Dallas. According to The East Valley Tribune, the bus fire occurred on the 10 Freeway northwest of Tucson. Fortunately, the driver of the bus and the 37 passengers onboard escaped major injuries. Three passengers suffered smoke inhalation and were treated at the scene and released. Officials say the fire was caused by a mechanical problem in the engine compartment.

It is indeed fortunate that this bus fire did not result in catastrophic injuries. Fires occur due to a variety of reasons, but the most common cause is some type of mechanical problem or failure. It is important to look into whether the mechanical problem occurred as a result of poor maintenance on the part of the bus company.

In cases where negligence is involved, the bus company can be held liable for any injuries caused to passengers. Injured Arizona bus accident victims can seek compensation for medical expenses, loss of wages, hospitalization or any accident-related treatment costs. Bus companies, whether they are private or public, owe their passengers the “utmost duty of care.” This means that bus companies are absolutely liable for what happens to their passengers in transit, especially if the Arizona bus crash is the result of driver negligence, error or wrongdoing.

Vehicles that Turn Left Cause Serious Arizona Car Collisions

By Arizona Personal Injury Lawyer on September 25, 2009 - No comments

Sometimes it is very difficult to find a personal injury lawyer after a serious car accident. That is not to imply that there are not enough lawyers, but rather that there are so many people who claim that they can handle individual cases. Cases in which a car turns left at an intersection, even when the other was issued a citation under Arizona Revised Statutes ARS 28 772, can become extremely complex. First of all, a vehicle taking a left turn at an intersection is required not to begin turning until they can safely do so. Secondly, the defense for the vehicle that collides with the left-turning often alleges that the other vehicle was speeding, even if a traffic citation was issued at the accident scene for the vehicle turning left.

Those who have been injured in left turn accidents should find the best Arizona personal injury lawyer that they can find. The reason this is so vital that someone in this position seeks legal counsel goes beyond finding the best Tucson personal injury lawyer or best Phoenix car accident attorney you can find. It means rather that an injury victim should find the Arizona personal injury attorney that fits his or her case. The right lawyer will give you honest answers, can guide you through the insurance claims process, and take your case all the way to a jury trial if that is what is necessary to get full and fair compensation for your claim.

Feel free to contact us if you have any questions. We will not charge you for the initial consultation, and work on a contingency basis in all of our personal injury cases. We will give you an honest evaluation of your potential claim so that you can decide on the best course of action for your particular case.

Seatbelts on Buses Could Help Prevent Serious Injuries in Accidents

A recent settlement that involved a tragic bus accident in which almost 70 people were either injured or killed shows how important safety is in bus accidents, and brings to the fore the subject of seatbelts in busses. Today, Arizona and other most states do not require seatbelts in busses, even though drivers and passengers of nearly every other vehicle are required to use seatbelts.

This accident shows why seatbelts should be considered, and probably required, in all busses. In this case, the uninjured bus driver was wearing a seatbelt. While most of the passengers were ejected during the crash, the driver’s seatbelt kept him strapped in safely.

Arizona bus accident injury lawyers like us understand that the issues surrounding this bus crash go beyond bus safety and the injuries incurred in this bus accident. Bus accidents will continue to happen, but everything possible should be done to decrease the possibility of personal injury or wrongful death. As ethical and experienced personal injury lawyers, we urge the State of Arizona and States throughout the country to consider implementing laws that require busses to have seatbelts available for passenger use.

An Arizona personal injury attorney can provide answers to those injured in bus accidents. The decision to file a personal injury claim in the event of a bus accident in which one is injured depends very much on the person and situation. It is important to know, however, that getting an Arizona attorney to file a “notice of claims” can often prevent a victim from losing all available rights. We feel it is important that people involved in a bus accident speak to a veteran lawyer so that they can make an informed decision. At Breter Law Offices, we are happy to answer any questions you might have if you or someone close to you has been injured in a bus accident.

Bus Accident Victims’ Families Can Have Proper Burial

The grief felt by the families of those Chinese tourists killed in the recent Arizona bus crash near the Hoover Dam must only get worse as six bodies of those who were wrongfully killed in this bus accident, aged from 15 to 56, were sent back to China.

The report goes on to raise some of the legal concerns around the bus crash. For those who would like to see justice for those wrongful deaths, they will have to wait until 2010 for the National Transportation Safety Board (NTSB) to issue its findings on the causes of the bus accident.

The fact that this report will be so long in coming should raise a red flag for anyone familiar with the personal injury system, and especially to personal injury lawyers who could bring claims for the families of those who died or were seriously injured. As the families in China almost certainly know nothing about American personal injury laws, it is an added tragedy that many legitimate claims may fall away due to the missing of important deadlines. This means that even if, as the initial evidence shows, the bus accident was entirely preventable and caused by negligence, these families will lose all right to file claims for personal injury.

We encourage those with severe injuries or families of those who have wrongfully died in an Arizona bus accident to immediately contact Breyer Law Offices or any other experienced Arizona bus accident attorney to help. We or other experienced personal injury attorneys will be able to tell injured parties whether or not there is a case, so that they can make a decision on whether to file suit. In such cases as the bus accident above, we believe those affected should contact an attorney from Arizona to deal with a case that most likely must be filed in an Arizona court.

We feel so strongly that people should have the necessary information before making a decision that we often have had to bring in translators to communicate with potential clients. When it comes to communication with clients, like other skilled Arizona auto accident lawyers, we are able to easily accommodate those who speak English and Spanish. Even so, we have had many other clients who spoke neither of these tongues, and were able to provide them with the necessary information to enable them to make the best decision on how, or even if, they should pursue their legal rights.

Arizona Bus Crash Near Hoover Dam Kills And Injures Tourists

The National Transportation Safety Board reported that the bus accident that took the lives of a number of Chinese tourists may have been the bus driver’s fault. There was initial speculation that there may have been something wrong with the door, which distracted the driver, and that “sun glare” also might have blinded the bus driver prior to him losing control. Preliminary investigation found nothing wrong with the door nor did they find any other mechanical problem.

These Chinese tourists were likely enjoying a wonderful occasion and vacation before their bus crashed. It is tragic and extremely unfortunate that lives had to be lost and it is probable that the families of the Chinese tourists involved in this wrongful death accident are unaware of what can be done in terms of seeking compensation for lost wages and other expenses.

As Arizona wrongful death attorneys and personal injury lawyers, we understand that though this case probably does not involve seeking “punitive damages,” the filing of a lawsuit in this situation may very well increase safety for people and perhaps prevent future bus accidents. Since companies are usually in the business to make a profit, the likelihood that the bus company will take safety precautions increases if they are forced to face a lawsuit and they are unlikely to take such measures if there is no threat to their bottom line.

Lives are saved through personal injury lawsuits. Assuming that what happened to this tour bus was preventable, had DW Tour and Charter of San Gabriel, California been exposed to previous lawsuits, they would have been more diligent about safety issues. It is unfortunate but sometimes necessary that companies be threatened with loss of profits in order to safeguard the lives and preclude serious injuries to innocent people.

Should anyone have questions about this bus accident or another serious bus accident, we invite those people to contact us at Breyer Law Offices, P.C. It is necessary that injured parties retain a lawyer from the state in which an accident occurred, or in this case perhaps the state in which the defendant is located, in order for negligent parties to be held responsible for the damages caused.
