Labor Day is Right around the Corner – Look Forward to Labor Rights Week

Labor Rights week seeks to enhance laws protecting workers and create discussion surrounding the civil and legal rights of laborers. On August 29, U.S. Secretary of Labor Hilda Solis joined ambassadors from countries such as El Salvador and the Dominican Republic in a partnership to defend the labor rights of migrant workers. The partnership includes a pledge to increase awareness and education surrounding the rights of laborers. Solis said that, “. . . No matter how you got here or how long you plan to stay, you have rights. You have the right to a safe and healthy workplace and the right to a legal wage.” Ken Atha, regional head of the Occupational Safety and Health Administration, pointed out that while national workplace fatalities have decreased, the rate of Hispanic workers injured on the job has actually increased – and added that Hispanic workers often are not as aware of their rights, and the working conditions that they should expect.

Despite advances in the field and increased safety regulations, serious injury and wrongful death can – and do – occur on the job. Arizona Personal Injury Law Firm Publishes School and Daycare Safety Infographic

The Husband and Wife Law Team published an infographic about school and daycare safety. The infographic shows the dangers of unqualified daycare providers and the use of physical restraint and seclusion in schools. As the proud parents of 8 children, the Breyer’s believe strongly in a safe positive learning environment for all students.

After researching the qualifications of many daycare facilities, the Breyer’s found some alarming statistics. According to the National Association of Child Care Resource and Referral Agencies, only 10 states require care givers who work from home to have a childcare license. According to the U.S. Bureau of labor statistics, 44 percent of workers in the child care industry have only a high school degree.

The infographic also shows that 900,000 children are abused or neglected in daycare centers each year and 70 percent of these children are under the age of 3, according to Fox News. Each year, 4.5 million children suffer misconduct by school employees, from inappropriate comments to sexual abuse. The most common type of child abuse is neglect, followed by physical abuse, sexual abuse, physiological abuse, and medical neglect.

Southwest Regional Lawyer Academy Viral Video Contest Winner is a School from Outside of San Antonio

With the number of injuries and death due to motor vehicle accidents, it isn’t a wonder that people in Arizona are standing up to help many others be aware of the safety practices in driving. The First Baptist Academy in Universal City Texas did just this, and they won the first annual American Lawyer Academy Viral Video Scholarship Contest.

This contest was held so that the public may be educated on safe driving practices. Mark and Alexis Breyer are the Husband and Wife Law Team who practice personal injury and wrongful death law in Phoenix, Arizona; and they sponsored the Southwest region.

Their teacher, Christi Steubben, had said that her class was active in joining contests online because they were confident in winning. 45 students, ages 11-17 worked on the video for three months, and the entire community was also involved in finding a wrecked car and then staging a funeral for the video. Promoting the video afterwards through family members, emails and social media sites helped up the vote on the video.

When the students were informed that they won, everybody celebrated in the hallway. The students then agreed that the scholarship money they won would be given to the school because during Memorial Day weekend, the school was vandalized and the windows in the bus and transportation vans were broken. Steubben was so proud of the maturity of the students, and their willingness to give.

Congratulations to the Regional Winner of the ALA Viral Video Scholarship Contest!

In the fall of 2010, the Husband and Wife Law Team, Alexis and Mark Breyer, of the Breyer Law Offices in Phoenix, Arizona, became the southwest regional sponsor for the American Lawyer Academy’s (ALA) Viral Video Scholarship Contest. The purpose of this contest is to help decrease the number of accidents by sending a positive viral message. Many high school and college students participated in the contest, but, alas, there could only be one southwest regional winner.

Alexis and Mark Breyer received so many good entries that they asked the public to help them narrow down their top 3 finalists by voting online. After reviewing the 3 promising finalists, the Husband and Wife Law Team made their decision.

The southwest regional winner is the entry entitled, “There’s a time to drive, and a time to text,” submitted by Christi Stuebben, Dual Computer Graphics Teacher at First Baptist Academy in Texas, on behalf of Nathan Vickery and the 8th grade class. They are now in the pool for the national 1st and 2nd place prizes of a $10,000 or $3,000 scholarship. Their video promotes the importance of safe driving through the story of a teen driver who took the life of a child because they made the mistake of texting while driving.

Preventing Personal Injury in Arizona this Holiday Season

The holidays are a time of happiness, when many people are able to spend more time with friends and family than they are during the rest of the year. However, the holidays can also be dangerous, and there is risk of personal injury occurring if a person isn’t careful.

Recently, CNN featured several safety tips in regards to holiday decorating that also double as money saving practices as well. According to the U.S. Department of Energy, the average home in America uses six times more electricity than a home did just 20 years ago. Lighting amounts for about 10 percent of your electric bill, which is sure to increase during the Christmas season with the addition of outdoor and indoor lights. Put your lights on a timer so you don’t need to worry about turning your lights off when you leave the house or go to bed, saving on costs. Timing your lights can also prevent fires from occurring.

The Electrical Safety Foundation International (ESFI) reports that about 250 fires start with a Christmas tree, and another 170 fires start with decorative lights every year. You should also think about buying LED lights, which use just 10 percent of the energy that regular lights use. They are also cool to the touch, which is important if small children or pets will be around.

You should also consider purchasing a fake Christmas tree, which is definitely a cheaper option as it lasts longer. Artificial trees are now made of non-flammable materials, further reducing your risk of a fire and consequential burn injuries occurring.

Be very careful when hanging holiday decorations and lights. The ESFI reports that about 5,800 people need to be treated in emergency rooms every year because of falls that are related to holiday decorating. Invest in a small step ladder to prevent accidents from occurring while you decorate.

Also, try using battery-operated candles instead of regular ones to reduce the chance of a fire. According to the ESFI, candles cause over 15,000 home fires annually. Battery-operated candles will also last longer, which is a good cost-saving measure.

Halloween Safety Tips for Phoenix Parents

With one of our children’s favorite holidays just a few short days away, we wanted to take a moment to think again about the safety precautions parents should take before sending their children out in efforts to fill their candy buckets. There are many more dangers that lurk on Halloween, such as an increased number of impaired drivers on the road, tripping hazards, and bad candy. AAA Arizona has put together a list of tips for parents to follow to help everyone have a safe and fun Halloween (Courtesy of KPHO 10/25/10).

  • When choosing costumes, stick with bright colors that can be seen at night.  Add reflective tape to clothing, shoes, and bags to help motorists see the trick-or-treaters, and have them carry a bright flashlight.
  • Check costumes for loose strings, buttons, or zippers that may pose tripping hazards.  Costumes should fit well and not be too long for the child.
  • Plan routes ahead of time, sticking with familiar houses on well-lit roads only.  Review Arizona pedestrian safety tips as well, such as walking on the sidewalk, crossing only at crosswalks, and looking both ways before crossing a driveway or street.
  • Children under 12 should always be accompanied by a responsible adult on their trick or treating outings.
  • Only take wrapped and sealed candy, and don’t allow children to eat any until they arrive at home and an adult inspects it.
