Tucson Car Accident Injures Pedestrian

As Tucson car accident lawyers, we were sorry to hear about a man who was injured after being struck by a vehicle near the University of Arizona Medical Center, according to news reports published in the Arizona Daily Star. The accident occurred on Wednesday, January 11, 2012 at 7:47 p.m. in the 2800 block of East Ajo Way. It is unclear the extent of injuries the man suffered, and police are still investigating the crash. We extend our prayers to the man and wish him a fast recovery.

Tucson Car Accident: Possible Causes

This Tucson car accident is still under investigation and it is unclear at this point exactly what happened and who is at fault. However, we often see pedestrian collisions like this one that are caused by distracted drivers. Because it was dark, it was likely that it was more difficult to see the pedestrian. If the driver wasn’t paying attention, it would be easier to miss spotting a person crossing the road. It is so important that all drivers remain aware of their surroundings at all times. Hitting a pedestrian is a very serious thing since cars are so heavy. Pedestrians can easily be killed in crashes.

Tucson Car Accident 2009 and 2010 Statistics

City-Data.com claimed 13 pedestrians were involved in Tucson car accidents in 2009. There were 1,449 pedestrian accidents in Arizona in 2010, according to the Arizona Department of Transportation (ADOT), which resulted in 156 fatal crashes and 1,178 injury crashes.

As Mesa pedestrian accident attorneys, we appreciate when cities release safety tips for their residents to follow. MesaAZ.gov has several tips to help pedestrians stay a little safer. As Mesa pedestrian accident attorneys, we know that pedestrian accidents can be extremely serious and even deadly since cars are very heavy and are often traveling at a high rate of speed.

Mesa Pedestrian Accident Statistics

According to a study published on the MesaAZ.org website, there were 120 Mesa pedestrian crashes in 2007 and 104 in 2008. There were seven fatal pedestrian crashes in 2008. Most Mesa pedestrian accidents occurred within a 2 ½ mile radius of downtown. Alcohol and drugs played a role in about 18 percent of all Mesa pedestrian accidents.

Mesa Pedestrian Accident Tips

Here are some tips to help avoid pedestrian accidents in Mesa:

  • Cross at crosswalks or when crossing guards are on duty;

Avoid Gilbert Pedestrian Accidents: Use the New Santan Trail

As Gilbert auto accident attorneys, we were happy to learn about a new trail that will extend 10 miles between Baseline Road and Germann Road in Gilbert, and hopefully reduce the number of pedestrian accidents in the area. The Santan Vista trail, according to a news report from The Arizona Republic, connects parks, shopping centers, schools, and neighborhoods. The trail will cost a total of $10.1 million and opened December 3. The trail also connects to the Western Powerline Trail and will feature art pieces and education-themed projects. The trail will be open to both pedestrians and bicyclists.

Gilbert Pedestrian Accident Statistics

There was one pedestrian killed in a Gilbert pedestrian accident in 2009, according to City-Data.com. There were five fatal Gilbert car accidents in all, two of which were caused by drunk drivers. And five people died in Gilbert car accidents.

Understanding Trail Ethics

There are trail ethics to consider when using trails in all states, including Arizona. The new trail was developed in part to keep pedestrians safe from Gilbert pedestrian accidents, but there are still rules to be followed to stay safe. These, from AZ2020.org, include:

  • Give faster hikers and bikers the right-of-way;
  • Groups should not block the trail;
  • Equestrians always have the right-of-way;
  • Bikers should maintain a slow, safe pace; and
  • Always ask an equestrian if it is safe to pass.

Phoenix Car Accident Causes Serious Injuries

The best Phoenix car accident lawyer will be able to tell a victim or his/her family things about the law that they do not know. Many people think injury claims are simple, but they are actually very complex. We are saddened to report that a serious injury took place on October 24, 2011 between a person in a wheelchair and a vehicle. The accident took place at 20th Street and Villa based on reports by ABC15. Police say the person in the wheelchair sustained serious injuries as a result of the accident.

Car Accident Statistics for Phoenix

In 2009, car accident statistics across Phoenix decreased 13% from 2008 and has been considered at the lowest rate of accidents for 20 years. 17-14 was the rate of accidents per 1,000 residents. Out of all the traffic fatalities in the year, pedestrians accounted for 26.3% of traffic fatalities.

Contact an Experienced Phoenix Pedestrian Accident Lawyer

An experienced Phoenix pedestrian accident lawyer most likely would hire an accident reconstructionist to investigate the scene of this car accident. Probably the scene of the accident will show skid marks and other evidence that will lead to the truth about who is at-fault for this accident. Arizona is what we call a comparative law state, so an experienced lawyer should be able to look at the facts and investigate the scene of the accident to determine what percentage of fault is attributed to each party. Under Arizona law, an injured person can collect for the percentage of fault that they are innocent. Therefore, even if you are partially at fault for an accident, you can still collect for pain and suffering. It will be up to the lawyer to prove the extent of your injuries, the percentage of fault, and the value of your claim. At the Breyer Law Offices, P.C., we have handled comparative fault cases for years. For your free consultation call (602) 457-6222. 2-year-old Boy Killed in Mesa Pedestrian Accident

The Mesa pedestrian accident lawyers of the Breyer Law Offices are very sad to report the death of a little 2-year-old boy. Children injuries and fatalities are particularly upsetting to us as we ourselves have 8 children. The accident occurred October 30, 2011, as reported by AZ Central. The fatal accident happened around 6 p.m. near Baseline and Recker roads.

The little boy was said to have been missing just a few minutes, and his family was looking for him as the accident happened. He was transported to a local hospital but later died of his injuries. Our thoughts and prayers go out to the family.

What Caused this Fatal Pedestrian Car Accident?

People may be fast to point fingers at the parents of this child; however, it may be that others are responsible. It has been reported that there were vehicles parked on the street. It may be that these drivers are responsible as well. Perhaps they should not have parked on the street and were partially responsible for the driver not seeing the little boy. Possibly, the driver was not speeding, but still going to fast for conditions. There are many other things that could have contributed to the boy being hit by the vehicle.

According to reports by ABC 15, the incident happened at about 5:30 p.m. on East Pennington Street when a man in his sixties was struck by a car as he crossed the street. Investigations appear to be reporting that the victim was not in the crosswalk when the accident happened.

Motorists and pedestrians alike are susceptible to fatal accidents. As reported by the National Highway Traffic Safety Administration (NHTSA), there were 120 pedestrians killed in Arizona in 2009 alone, which makes up approximately three percent of the country’s total pedestrian fatalities for the year.

Pedestrian Rights and Duties

Pedestrians have their share of responsibilities in order to avoid accidents. Crosswalks and traffic signals, for example, are to be observed in order to ensure safety. A pedestrian using a crosswalk has the right of way as stated by the law, thus requiring approaching vehicles to yield (28-792).

Needless to say, however, even on a crosswalk pedestrians must practice utmost care and should stay alert when crossing the street. Drivers must also pay special attention to pedestrians even if they are not in the crosswalk.

Unfortunately, pedestrian accidents are rising at an alarming rate. State-wide, more than 1,500 pedestrians are involved in accidents annually. 1,300 of these are ones that are injured, equalling to more than three people injured daily. Pedestrian Killed in Glendale Car Accident

A pedestrian was killed in a Glendale car accident after being struck by an out-of-control car. According to a news report in The Arizona Republic, the fatal pedestrian accident in Glendaleoccurred near the intersection of 59th and Olive avenues. The vehicle involved in the crash crossed over from the northbound lanes across the southbound lanes and onto the sidewalk before striking the pedestrian. The pedestrian died at a nearby hospital and two people in the car were also hospitalized. It is unclear what caused the crash or if the driver will be cited for the fatal collision.

Under Arizona Statute 28-904: “A person shall not drive a vehicle on a sidewalk area except on a permanent or duly authorized temporary driveway.” Whenever a driver goes off a roadway it must be determined what caused the driver to lose control. Was the driver speeding or driving distracted? Was the motorist under the influence of alcohol at the time of the crash? Did the driver suffer a medical condition? Was speed a factor in the crash?

In cases where negligence or wrongdoing is involved, the family of a deceased pedestrian accident victim can file what is known as a wrongful death claim. Such a claim usually seeks compensation for medical and funeral expenses, lost future income and benefits and emotional distress.

The skilled Glendale wrongful death attorneys at The Breyer Law Offices P.C know how to hold at-fault drivers accountable for their actions.
