A division of Johnson and Johnson, DePuy Orthopedics, issued a recall notice to all patients who used two of their devices. The DePuy ASR XL Aceabular Hip System and the ASR Hip Resurfacing System, both a commonly used hip replacement device, were recalled due to the high failure rate of these devices.
The Failure Rate of a DePuy Device
Hip replacement surgery is expected to last in patients for roughly 15 years. However, patients whose doctors or surgeons used one of the two DePuy devices had to go in for a second, extremely painful, and expensive hip replacement surgery. This second surgery was usually required within 5 years of the first initial surgery.
What Causes the Problem in These Hip Replacement Devices?
The main source of the problem that led to the recall of the DePuy Orthopedics devices was the replacement cup. The replacement cup in DePuy devices is made to be shallower than other competitor’s hip replacement devices. The shallow cup makes it difficult for surgeons and patients to align the device up with the patient’s body. An improperly aligned device can lead to extreme pain, swelling, and limited mobility. Patients who had one of the two DePuy devices started to complain to their doctors that they were experiencing pain, swelling, and limited mobility within a year of the surgery.
Another problem patients experience with the DePuy Orthopedic devices was the possibility of excessive friction causing metallic particles to be released into the blood stream. Metallic shavings were a result of the excessive friction caused by the ball and cup elements of the device. Prolonged exposure to metallic shavings in the blood stream can result in dementia, heart attacks, strokes, and deafness in some patients.
What Should You Do If You Have a Defective DePuy Hip?
Patients who have had a DePuy ASR hip replacement device implanted before 2003 may be eligible to receive compensation for any medical expenses that resulted from this defective device. Patients who experienced any of the following should consider contacting a doctor who can provide them with medical advice:
- Pain and swelling after their hip replacement surgery
- A second surgery was required to replace a DePuy ASR device
- X-rays were performed to determine if a potentially DePuy ASR device was implanted
- A DePuy ASR device was implanted before 2003
It is estimated that close to 90% of all hip replacement patients before 2003 may have had a Depuy ASR device implanted. For more detailed information about the recall, please contact a California DePuy attorney.

As Tempe car accident attorneys, we were shocked to learn that a Tempe man deliberately hit his 19-year-old stepson with his car after an argument. The stepson had been trying to stop him from driving drunk and arguing with his wife, the teen’s mother, according to AZ Central. The three were in a car together when the mother, who was driving, pulled over and exited the car with her son. When they began walking away, the Tempe man jumped in the driver seat and hit the teen near Holmes Avenue and Alma School Road. He then fled, but was stopped by officers a few miles later when they saw him speeding past. The teen suffered bruising to his legs and face. We wish him a quick recovery.
Does the Stepson Have a Personal Injury Claim?
Many people are unaware that in situations like this the stepson may have a personal injury claim. Many times, passengers and others who are hit by the driver of the vehicle still have legal rights even though they may have chosen to ride with someone drunk or if they were trying to stop someone who was drunk from driving. In cases like these, it is important to remember to always take steps to understand your legal rights.
Contact a Tempe Personal Injury Attorney
A knowledgeable Tempe personal injury attorney knows that it is a serious crime to drive drunk and also a serious crime to deliberately hit another person with a car. The stepson and wife probably do not want to bring a criminal claim against the dad/husband. That being said, a claim against the insurance could always be made depending on the seriousness of the stepson’s injuries. If the stepson did not require any medical care, it is likely they would not want to bring a claim. We have had other cases like these where, in similar circumstances, the drunk driver seriously injured the other party. In cases like those, medical bills can sky rocket and lost wages can be incurred, bringing the person in a situation where they are best to bring a claim against the drunk driver’s insurance. If you have been injured in a scenario similar to this one, we are happy to answer all your legal questions. Contact us today for your free consultation.

A Phoenix personal injury attorney is an attorney that helps people who are injured as a result of someone else’s negligence. Personal injury attorneys typically help all injury victims, regardless of how the injury occurred. The most common types of injuries are car accidents, motorcycle accidents, slip and falls, bike accidents, construction accidents, and nursing home abuse cases. Of course, there are many other ways that people are injured, including dog bites, pedestrian accidents, assaults, and swimming accidents. Whenever someone is injured or there is a fatal accident and it is due to the fault of another individual, it is likely that a personal injury lawyer is the correct type of lawyer to seek legal guidance from to see if you have a valid claim. Injury lawyers work hard to uncover evidence and put together information to prove that the innocent individual was injured because of the negligence of another person.
Phoenix Personal Injury Statistics
Here are some of the Phoenix personal injury statistics from the past several years:
- There were 29,062 Phoenix car accidents in 2010, leaving 149 dead and 15,050 injured, according to the Arizona Department of Transportation (ADOT).
- There were 525 Phoenix pedestrian accidents in 2009, according to AZ Central.
- There were 467 Phoenix bicycle accidents in 2009, according to AZ Central.
- Approximately 1,000 people are treated every day for dog bite injuries in the United States, according to multiple sources, and approximately 4.7 dog bites occur each year, according to the American Humane Association.

If you have been injured by the fault of another person, it is best to consult with a personal injury lawyer to see if you have a claim. Many claims that are brought against at-fault parties help prevent future injuries to other people. There are many statute of limitations, though, that are necessary to know and that can be hidden in the law. An injured person or the family should at the very least be informed about their legal rights. Arizona exceeds the national average for injuries, which prompted the Arizona Department of Health Services (ADHS) to partner with the Centers for Disease Control (CDC) to develop a program designed to prevent injuries. This program has four major objectives:
- Identify injury issues and determine specific needs for programs and policies designed to prevent injuries.
- Stay abreast of developments in the injury prevention field.
- Understand how injury prevention fits in with the responsibilities of other Arizona agencies.
- Support injury prevention activities within the state of Arizona.
Since its implementation in 2000, this program has led to several achievements. The Arizona Department of Health Services published the “Arizona Injury Surveillance and Prevention Plan” report covering the period from 2006 to 2010. ADHS also appointed an external injury prevention advisory council and started an internal injury prevention work group. The program also aims to develop relationships with local councils and community coalitions designed to spread information about injury prevention.
Despite the progress made by the people involved in the injury prevention program, Arizona’s injury statistics continue to top those of other states. Burns, accidental drowning, construction accidents, auto accidents, and other injuries continue to kill and maim Arizona residents. Victims of these accidents struggle with pain, discomfort, and disfigurement, all while worrying about the cost of emergency care, surgery, and rehabilitation services.

Filing an Arizona personal injury lawsuit can help you recover money needed to pay for your medical expenses and other accident costs. Although you cannot control every factor that determines the outcome of your case, there are several things you should avoid to reduce the risk of losing your Arizona personal injury case. These things can put the outcome of your case in jeopardy and leave you without the compensation you need to pay your expenses.
Lying or Exaggerating About Your Injuries
Avoid exaggerating or outright lying about your injuries when speaking to a doctor, nurse practitioner, physical therapist or other health professional. Medical care providers often document your statements. If your report differs from the one you gave to the police, the defendant’s insurance company can use these differing descriptions to try to prove that you are lying.
Failing to Contact the Police
You should always contact the police after an accident. The information in a police report plays a big role in the outcome of your case. If you do not have a police report at trial, you may lose.
Avoiding Medical Treatment
Seeking medical treatment after an accident is one of the best ways to document your injuries. If you do not seek medical care, you will have a hard time proving that your injuries occurred as the result of the accident. Additionally, the opposing attorney can argue that your injuries were not that serious if you did not seek treatment.
Talking With an Insurance Representative
You should avoid speaking with anyone from your insurance company after an accident. Attorneys have experience dealing with these companies and handling the communications necessary after an accident. Allow your Phoenix personal injury attorney to communicate with all insurance company representatives.
Failing to Hire an Attorney
You should seek the advice of a legal professional after any accident. The laws are complex, so having a personal injury lawyer on your side can mean the difference between winning and losing.

Many people think of thumb and finger fractures as nothing more than an inconvenience, but these injuries can lead to serious complications if not treated correctly. If a patient experiences complications, or the treating physician does not maintain proper alignment and rotation while the fracture is healing, the fracture could cause a permanent loss of function.
Potential Complications
Possible complications of thumb and finger fractures include degenerative arthritis, malunion, nonunion, infection, malrotation, joint contracture and adhesion of the tendon to bone. Improperly treated fractures may also result in finger deformities. These deformities can make it difficult to perform normal activities.
Treatment
Most finger and thumb fractures require the use of a splint to immobilize the affected finger and prevent additional injuries. Holding the finger straight while it heals also helps prevent complications. In complicated fracture cases, a physician may use surgery to place wires, screws and pins used to hold the fractured bones together. Complicated fractures may also require expensive physical therapy, occupational therapy and rehabilitation work by a hand specialist.
Impact on Work
Work restrictions depend on the severity of the injury and the amount of dexterity required on the job. Someone who types frequently may need special accommodations such as a one-handed keyboard or speech recognition software. Someone who performs very precise work, such as a surgeon or mechanic, may need to take time off or perform modified duties until the injury heals. The most severe fracture complications may make it necessary to change jobs if loss of function becomes permanent.
Costs
The financial and emotional costs of complicated finger and thumb fractures can be devastating. Permanent loss of function can also result in reduced income potential, making it difficult to pay for medical care and other expenses. An experienced Arizona accident attorney can review your case to determine if you have a valid claim.

Many believe that there’s a high level of murder, terror, and mayhem in Arizona; however, records show that there is a decrease in crime rates and in other border states. According to the FBI’s preliminary UCR (Uniform Crime Report) for 2009, violent crimes in Arizona were down for the third year in a row by 15% since 2006. An approximate number of crimes in 2006 was 30,916 and has dropped to 26,094 in 2009.
In recent news, police have identified the three people who were shot and killed late Friday night at 11:20 p.m. during a motorcycle rally in Northern Arizona. The one injured is a 33 year old woman who received six gunshot wounds but managed to survive and is still recovering at the Flagstaff Medical Center. Reports say that one of the victims was suspected to be involved in a verbal argument with someone regarding food, which led to the shooting. Witnesses say the cause was a mix of murder, jealousy, and alcohol.
The combination of alcohol and violence often leads to severe injuries or death. Although the crime rate has begun to decrease in the state of Arizona, violent crimes still occur. Report any suspicious behavior or threats to the police.

Hiking and playing sports are a great way to stay active however, there is always the danger of a fall. Falls a can lead to moderate to severe injuries, such as hip fractures and head traumas, and can even increase the risk of early death.
In recent news, a 64-year-old woman was reportedly injured when she fell from a trail while she was hiking on Mount Elden (AZCentral 07/20/2011). The Flagstaff Fire Department received a 911 call about the woman. Afterwards, fire department and medical transport personnel were deployed, hiking on the mountain until they found the woman. Fourth of July is a federal holiday in which every American celebrates to commemorate the Declaration of Independence on July 4, 1776. This day is often associated with parades, carnivals, fairs, picnics, fireworks, family reunions, political speeches and many other traditions in the United States.
Independence day usually takes place in outdoors wherein family can host picnics and family reunions. Parades happen in the morning while firework displays occur in the evening at places such as parks, townsquares.
However, fireworks-related injuries and deaths are the main concern during the Fourth of July celebrations. According to the Consumer Product Safety Commission (CPSC), there were reports of three fireworks-related deaths and an estimated 8,600 hospital emergency room treated injuries in 2010. Injuries to children were a major component of total fireworks-related injuries, with children under 15 years of age accounting for approximately 40 percent of the estimated injuries. Fifty-three percent of the estimated emergency department-treated, fireworks-related injuries were individuals younger than 20 years of age.
Fourth of July is an important celebration that all of us, including the children should partake. In this way we can instill in them the importance of this day at an early age. Bringing our children outdoors is likewise very risky due to the dangers of fireworks-related accidents.
Fireworks and celebrations go together especially during Fourth of July. It is hard to imagine Independence Day without fireworks. Thus, to prevent the kids from being injured during this day, here are some safety tips from CPSC:
- Never allow young children to play with or ignite fireworks.
- Avoid buying fireworks that are packaged in brown paper because this is often a sign that the fireworks were made for professional displays and that they could pose a danger to consumers.
- Always have an adult supervise fireworks activities. Parents don’t realize that young children suffer injuries from sparklers. Sparklers burn at temperatures of about 2,000 degrees – hot enough to melt some metals.
- Never place any part of your body directly over a fireworks device when lighting the fuse.
- Never try to re-light or pick up fireworks that have not ignited fully.
- Never point or throw fireworks at another person.
