Product Recall

Taylor Farms Recalls Bagged Salads Due to Salmonella Concerns

According to The Prescott Daily Courier, Taylor Farms has issued a voluntary recall of 3,265 cases of bagged salads due to contamination by salmonella after The Washington Department of Agriculture discovered the contamination during random testing. The food recall applies to the following brand names:

  • HEB
  • Marketside
  • Taylor Farms
  • Fresh Selections

The bagged salads were distributed in Arizona and several other states. The recall is a precaution, as no one has reported any illness attributed to the recalled salads. In Arizona, the bagged salads were sold at Fry’s grocery stores. Consumers can find out the exact items, sell by dates, and UPC codes by visiting www.fda.gov/Safety/Recalls/ucm276459.htm.

Salmonella causes serious infections, particularly in young children, elderly people, and those with health conditions that compromise immune system function. The incubation period for these infections can last from just a few hours for up to two days. Signs and symptoms of salmonella infection include fever, nausea, chills, vomiting, bloody diarrhea, abdominal pain, muscle pain, and headaches. If you have eaten any of the recalled products and experience these symptoms, seek medical attention.

Depending on the severity of the infection, symptoms may last up to one week. The Mayo Clinic has stated that it may take several months for bowel function to return to normal.

If you or a loved one contracted a serious infection due to ingesting a contaminated food product, you deserve financial compensation for your medical expenses and lost work time. The experienced Chandler product liability attorneys at The Breyer Law Offices P.C. will help you fight for justice. Contact us at (602) 457-6222 to discuss your case at no charge.

Defective Drain Covers May Cause Serious Swimming Pool Accidents

Eight manufacturers of pool and in-ground spa drain covers have recalled about 1 million of these defective products for possible entrapment hazards. According to the U.S. Consumer Product Safety Commission (CPSC), the recall includes pool drain covers made by Arizona companies, A&A Manufacturing and Color Match Pool Fittings. CPSC reports that the recalled drain covers are not capable of handling the flow of water through the cover and swimmers run the risk of being entrapped by them. At the time of this report, there have been no serious injuries reported because of the defective products. Anyone who has one of these defective drain covers in their pool would be well advised to contact the manufacturer of the cover to have it replaced or retrofitted right away.

CPSC released a report in May 2011 which stated that there have already been 55 drowning accidents and 63 near-drowning incidents in 29 states just in 2011. There are many potential causes of swimming pool accidents including defective pool products, dangerous pool areas, lack of supervision and a failure to provide safety devices.

Families with pools would be well advised to provide adequate fencing around their pool area and to provide focused supervision whenever a child is near the pool. The CPSC report also stated that 96 percent of drowning victims die within a week of the accident. It only takes a moment for someone to suffer a serious injury or death because of an Arizona swimming pool accident.

In cases involving property owner negligence or defective products, injured victims and their families may pursue financial compensation for the injuries, damages and losses sustained. CPSC Re-Issues Recall for Defective Maclaren Strollers

The U.S. Consumer Product Safety Commission (CPSC) has reissued a recall notice for Maclaren strollers due to the risk of amputation. According to an Associated Press news report, there were 37 injuries since the stroller was originally recalled in November 2009. These single and double umbrella strollers had a defective hinge mechanism that could sever a child’s finger when the stroller was being opened. So far, the government has received reports of five fingertip amputations, 16 lacerations and 16 fingertip entrapments.

About 1 million Maclaren strollers that were sold between 1999 and 2009 were included in that recall. A total of 149 incidents have been reported with regard to these strollers. All Maclaren strollers manufactured after 2009 have a different hinge mechanism that offers protection against fingertip amputation.

Defective products have the potential to cause serious injuries. The nature and extent of the injuries can vary. Sometimes, the injuries can be as minor as cuts or abrasions. However, certain products can cause serious and irreversible injuries. In any product liability case, a victim must prove that he or she was injured by a product while using it as it was intended. Product manufacturers have a legal obligation to put safe products in the market.

If you or a loved one has been injured by a dangerous or defective product, the Arizona product liability attorneys of The Breyer Law Offices P.C. can help.
