Workplace Injury

Acid Spill Sends Tempe Workers to Hospital

An acid mixture boiled over the edge of a vat at a Tempe plating facility Friday morning, according to a report from Jordee Kalk of The Arizona Republic. The incident, which occurred near 1100 W. Geneva Drive, caused two workers to inhale fumes. They were treated at the scene and then transported to the hospital in a private vehicle. Tempe fire officials inspected the accident site to ensure the business was cleaning up the acid spill in a safe manner.

Businesses have a responsibility to protect their employees from safety hazards, especially when employees work with dangerous chemicals and equipment. When an incident like this occurs, it can cause debilitating injuries and even death. Inhalation of fumes is just one of the many incidents that can occur at this type of company. Other types of industrial accidents include the following:

  • Forklift/baler accidents
  • Chemical burns
  • Radiation exposure
  • Exposure to extreme temperatures
  • Building collapses
  • Slips and falls
  • Being caught between objects
  • Ingestion of harmful substances
  • Exposure to harmful airborne particles

One way employers can minimize the risk of workplace accidents is by training employees to use appropriate safety precautions. Employers should also provide personal protective equipment, such as goggles and gloves, for employees who will be handling harmful substances.

Unfortunately, some employers try to cut costs by skimping on training or failing to provide the necessary safety equipment. If you’ve been injured in a workplace accident, you may experience long-term physical effects as well as the stress of worrying about missed work time and lost income. The Tempe workplace injury attorneys at The Breyer Law Offices P.C. will fight for your right to recover compensation for your injuries and the effects they have had on your life. Arizona Workplace Injury Survey Shows Surprising Results

By Arizona Personal Injury Lawyer on September 21, 2011 - No comments

Industries such as agriculture and manufacturing have typically resulted in more injuries than other types of occupations. Results of the most recent survey of work injuries paint a different picture. Perhaps due to better working conditions and more stringent safety rules, the agriculture, mining, and manufacturing industries are not in the top three causes of workplace accidents for 2009.

The industries with the most injuries are ranked as follows:

  1. Services
  2. Retail
  3. Construction
  4. Transportation
  5. Manufacturing
  6. Wholesale
  7. Agriculture
  8. Finance/Insurance
  9. Mining

Sprains and strains account for the biggest percentage of workplace injuries, followed by these issues:

  • Fractures
  • Bruises/Contusions
  • Cuts/Lacerations
  • Burns
  • Amputations
  • Chemical Burns
  • Carpal Tunnel Syndrome

Back injuries top the list of reasons for lost work time, followed by knee, ankle, wrist, head, and neck injuries. These injuries cost employers millions of dollars each year, highlighting the need for safety training, implementation of workplace safety programs, and availability of appropriate safety equipment in the workplace.

When employers refuse to spend money on safety equipment or take the time to train employees, they are putting everyone at risk. Simple steps, such as implementing a safety committee to identify potential hazards, can save employers money and help employees avoid workplace accidents. Employers can encourage employees to maintain safe work habits by implementing financial incentives tied to safety.

Arizona Firm Cited for Multiple Safety and Health Hazards

MedPlast Inc. has been cited by the Occupational Safety and Health Administration (OSHA) for exposing their workers to safety and health hazards. According to OSHA’s website, the $72,000 in fines is related to hazards at a New Jersey facility. The Arizona-based firm has been charged with disregarding OSHA standards and exposing workers to conditions that could result in serious injury or death. Failures exposed by OSHA investigators include blocked exits, lack of eye protection, lack of safety training and improperly storing oxygen and acetylene fuel gas cylinders. It is not clear from the report what actions the Tempe-based company will take in the future to protect its workers.

Arizona employers must provide reasonably safe work conditions for their employees. This obligation includes providing proper training, safety devices, properly inspecting all equipment and machines, and making sure that the workers are not exposed to toxic substances. Certain Arizona jobsites such as manufacturing plants are notorious for fostering unsafe work conditions that put workers at risk.

When a worker is injured, he or she should immediately report the accident, seek medical attention and then discuss his or her legal rights and options with a skilled Arizona workplace accident attorney. A 54-year-old man was killed in a Phoenix on-the-job accident while working on an air conditioning unit on a rooftop. According to a news report, the fatal accident occurred on the roof of a warehouse near First Avenue and Lincoln Street in Phoenix. Two men were working on a large industrial cooler when one of the men was killed. Initially, it was believed that the man was electrocuted. An investigation is underway to determine what caused his death and what caused the burn marks on his hand. The other man working with him was not injured.

Two Suffer Burn Injuries in Scottsdale Restaurant Fire

A kitchen fire in a Scottsdale restaurant resulted in two people suffering burn injuries. According to an ABC 15 news report, the fire accident occurred at a steakhouse in Scottsdale. The Arizona Republic reports that the restaurant’s manager and cook were hospitalized following the fire. One of the victims suffered burns to his hands and the other sustained flash burns to his face. The fire remained contained in the kitchen and Scottsdale firefighters were able to quickly put it out. Investigators suspect that a gas leak may have led to the dangerous Arizona workplace fire.

When most people think of dangerous workplaces, they think of construction sites and roadways but a work injury can happen anywhere. It is the obligation of an employer to provide a safe workplace for employees. In such cases, employees can file workers compensation claims seeking lost wages and coverage of medical expenses.

In Arizona, workers compensation insurance may provide financial compensation for losses such as medical expenses and a portion of the wages lost during the recovery process. Additional compensation may be available for victims of serious injuries that result in either an extended period of time away from work or a permanent disability. Anyone seriously injured in a Scottsdale work accident would be well-advised to seek the counsel of an experienced work injury lawyer.

The knowledgeable Arizona workplace injury attorneys of The Breyer Law Offices P.C. have successfully handled numerous workers compensation cases. Our goal is to provide workers’ legal rights and help them secure the compensation they need and deserve to get better and return to work. Circumstances That May Allow A Civil Lawsuit Following A Workplace Injury

Workers compensation insurance exists to protect Arizona workers who are injured on the job. It does not, however, always provide adequate coverage for the many serious injuries that can occur at an Arizona jobsite. Under certain circumstances, the injured worker may be able to file a civil lawsuit in addition to his or her workers compensation claim to receive additional compensation for the damages suffered.

Examples of workplace accidents that could merit a civil lawsuit include toxicity-related injuries and defective product injuries. Contractors or sub-contractors who are required to maintain a safe worksite for employees can be held liable. In cases where a defective product caused an injury accident, the manufacturer of the defective product can be held liable as well. Common defective products at work sites include tools, cranes, ladders, machines, tires and appliances. These civil lawsuits, which are filed against parties other than an employer, are known as third-party claims. Such claims are usually worth a lot more than workers compensation benefits.

It is rare that a worker may sue his or her own employer, but there are circumstances that may allow it. An injured worker may sue an employer if the employer failed to provide workers compensation insurance or if the employer’s deliberate conduct led to the injuries suffered.

Prevent Peoria Construction Accidents through Accountability

One way to ensure that more people are not hurt in the future is to encourage claims to be made when appropriate, and to hold construction workers accountable for unsafe work practices when they lead to injuries to others.

If nobody is held accountable for a construction accident or work-related incident, workers are less likely to act in a safe manner in the future. Therefore, finding a top Peoria construction accident lawyer to help an injured worker bring a personal injury claim not only benefits that worker, but may have a deterrent effect to help prevent injuries to other people.

This fact only becomes more important as Peoria continues to grow and more and more people are employed on construction sites throughout Peoria, Maricopa County, and the state of Arizona.

If you have been injured while at work, a skilled Arizona personal injury attorney at Breyer Law Offices, P.C. may be able to help. We understand that there is much to consider after being injured as the result of another person’s negligence. Please contact us today for a no-obligation, free consultation.

Injured Peoria Construction Workers Deserve the Best Compensation

In recent years, Peoria has seen a lot of growth. That growth includes the creation of jobs for people in the building trades and construction industry. Unfortunately, construction sites are often extremely dangerous places. Construction workers risk catastrophic injury on a daily basis.

Many times people who work in the construction industry believe that if they are injured on the job their only recourse is to make use of workers’ compensation in Arizona. But actually many construction site injuries in Peoria and surrounding areas not only allow for workers’ compensation claims to be made, but also allow for personal injury claims to be made in addition.

As Arizona personal injury attorneys, we know that workers’ compensation claims following a construction injury are very important for the injured worker. They provide for medical care, although not always the best possible medical care available. Workers’ compensation claims also allow for repayment of lost wages, although not always in full. Because workers’ compensation does not provide for full repayment and impeccable medical attention, making a personal injury claim to allow care that is potentially better, repay lost wages in full, and provide money for pain, suffering, loss of enjoyment of life, frustration, and all other aspects of a worker’s life that have been altered by a construction injury is a useful benefit to the person who was hurt.

Contact Breyer Law Offices, P.C. for more information regarding your legal options after being injured in a construction accident caused by another person’s negligence. We have assisted many construction workers in successfully obtaining the best compensation for their injuries. Vehicles that Turn Left Cause Serious Arizona Car Collisions

By Arizona Personal Injury Lawyer on September 25, 2009 - No comments

Sometimes it is very difficult to find a personal injury lawyer after a serious car accident. That is not to imply that there are not enough lawyers, but rather that there are so many people who claim that they can handle individual cases. Cases in which a car turns left at an intersection, even when the other was issued a citation under Arizona Revised Statutes ARS 28 772, can become extremely complex. First of all, a vehicle taking a left turn at an intersection is required not to begin turning until they can safely do so. Secondly, the defense for the vehicle that collides with the left-turning often alleges that the other vehicle was speeding, even if a traffic citation was issued at the accident scene for the vehicle turning left.

Those who have been injured in left turn accidents should find the best Arizona personal injury lawyer that they can find. The reason this is so vital that someone in this position seeks legal counsel goes beyond finding the best Tucson personal injury lawyer or best Phoenix car accident attorney you can find. It means rather that an injury victim should find the Arizona personal injury attorney that fits his or her case. The right lawyer will give you honest answers, can guide you through the insurance claims process, and take your case all the way to a jury trial if that is what is necessary to get full and fair compensation for your claim.

Feel free to contact us if you have any questions. We will not charge you for the initial consultation, and work on a contingency basis in all of our personal injury cases. We will give you an honest evaluation of your potential claim so that you can decide on the best course of action for your particular case.

Arizona Police Denied Justice

There is an archaic law known as the firefighter’s rule. The rule has been done away with in multiple states throughout the country. Unfortunately, Arizona punishes its own firefighters and police officers with unjust laws such as the firefighter’s rule. The firefighter’s rule says that somebody who was badly injured or killed while working as a police officer has no right to bring a lawsuit against the negligent person who caused their injury. This even includes a situation where somebody negligently did something that directly led to the death of one of our brave police officers or firefighters.

Somebody who puts their life on the line has a right to hold negligent people responsible for what they’ve done. There is far too much misinformation and far too many people believe they have no right to bring any kind of insurance claim or lawsuit outside of workers’ compensation. While this is true sometimes, there are other situations where a top Arizona injury lawyer can help overcome the hurdle created by this unfair and unjust law.

If you have questions about any case involving a serious injury or the death of a loved one who was on the job as a firefighter or police officer please do not hesitate to give us a call. At Breyer Law Offices, we have fought the fight for police officers. We have overcome motions to dismiss their cases to make sure that people who are seriously injured in the line of duty are not denied the compensation they need and deserve for the serious injuries they have suffered.
