Wrongful Death

Fatal Motor Vehicle Accidents in Phoenix Kill 2 People

As experienced Phoenix car accident lawyers, we were surprised to hear of the reports by ABC15 regarding two separate car crashes that occurred on the same road on October 30, 2011. Police first responded when a 28-year-old man was struck by an SUV as he was crossing on Cave Creek Road near Grovers Avenue. The driver of the SUV stopped at the scene of the accident. The second deadly accident happened a few hours later when a woman driving a motorcycle went off the road and hit a pole. The 24-year-old woman was said to not have been wearing a helmet. Police continue to investigate the reason why the motorcyclist went off the road.

We send our sincerest condolences to the family of the victims.

It may be that the City is partially responsible for these accidents, but one would have to investigate the accident scene. In related news, a drowning accident was reported Monday in south Phoenix after a 7-year-old boy was found at the bottom of a pool while attending an Independence Day party (AZ Central 07/05/2011).

According to the Phoenix Fire Department, the unidentified victim became the 11th person to die this year in Phoenix from drowning.

Family members found the boy at the bottom of a small, murky pool and he was given CPR before being transported to a Phoenix hospital.

Seventeen adults and 20 children were present at the party before the fatal accident happened.

Phoenix Fire Department adds that it was the 40th drowning call they have received for this year and that out of the 11 drowning deaths, five of the victims were children.

To protect kids from drowning accidents, make sure they are not left unattended at all times when near bodies of water. Keep bathroom doors closed and the backyard pool covered when unused. Also, do not leave an older child to look after younger ones. Instead, adults should be looking after them.

State Route 68 Crash Kills Motorcyclist

Motorcycle accident deaths are one of the primary concerns in road safety. According to the National Highway Traffic Safety Administration, motorcyclists are at a bigger risk to end up in a fatal accidents compared to automobile drivers. For every 100, 000 registered motorcycles, NHTSA estimates 72 .34 are involved in fatal crashes while for automobiles, the rate is 13.10

A motorcycle was involved in a fatal accident which happened in the northwest Arizona community of Golden Valley (LVRJ 06/19/2011). According to the Arizona Department of Public Safety, the accident involved two motorcycles and a vehicle.

Authorities say the three were travelling in the same direction on state route 68 and at least one of the motorcycles came into contact with the vehicle which resulted in the crash.

One of the motorcyclists was killed in the wreck.

This incident reminds us of the risks involved when riding on a motorcycle. Before going out on a trip, make sure that you have the sufficient skills to avoid any accident which may cost your life or the lives of others.

But even those who have mastered motorcycle riding are not exempt from becoming a victim of a tragic accident. It is important that safety is a priority when riding. Riders should wear protective clothing and carry safety equipment. As well as avoid travelling at high speeds.

1 Killed, 2 Injured in a Head-On Car Collision in Fountain Hills

Did you know that the leading cause of unintentional wrongful deaths for all ages in the United States in 2007 was car accident injuries, according to the Centers for Disease Control and Prevention (CDC)?

Irresponsible and reckless drivers are the main cause of fatal car accidents. Although the total number of fatal car crashes in Arizona as well as the United States has declined the past few years, those statistics mean nothing to the families that still lose their loved ones every day because of irresponsible drivers. There are many causes of Arizona wrongful death car accidents: the abrupt switching of lanes, drunk driving, driver fatigue, carelessness, and speeding are just a few of these causes.

A fatal Arizona car accident occurred the night of November 23 when a wrong-way driver crashed head-on into an ambulance in Fountain Hills. According to AZ Central, authorities received a call about a Honda Sedan driving in the wrong lanes on Arizona 87 and Bush Highway. After a few minutes, another call was received reporting a wrong-way collision involving a Life Star Ambulance. The driver of the Sedan was killed in the incident while the two passengers of the ambulance were taken to Scottsdale Hospital. Authorities do not suspect impairment to have been involved at this time.

Every year, nearly 5 million people sustain injuries in car accidents that require immediate emergency medical attention (CDC 10/17/10). An August 2010 study by the CDC found that the annual cost of medical care and productivity losses totals over $99 billion dollars. There are many preventative measures drivers can take to make their road trips safer; such as using safety belt use, obeying traffic laws, and refraining from cell phone usage. These are all easy choices drivers can make to keep themselves and others safe on the road.

When Do I File a Scottsdale, AZ Wrongful Death Claim?

Wrongful death cases in Arizona can sometimes be done in a matter of months, but other times could take many years. Certain wrongful death cases do not require much contact between the family and anyone else than the lawyer they hire. In other cases, the lawyer they hire will work with the family through a personal injury case that could go all the way to trial.

Therefore, it is very important for a family that has lost a loved one in a wrongful death situation to first contact a lawyer that will tell them the absolute truth about the strengths or weaknesses of their case. It would be horrible to add to the tragedy a family has already suffered to have to go through a lawsuit and go to trial on a case that never should have been brought. Therefore, getting expert advice from a certified specialist in personal injury and wrongful death litigation in the State of Arizona is a vital first step. Making sure it is a lawyer that will communicate honestly with the family is absolutely necessary.

Wrongful death cases are settled one time and one time only. Therefore, if the lawyer that is hired does not do the best possible job, there is no chance after the settlement to bring another case. That is why it is so important for a family that is considering bringing an Arizona wrongful death claim to find an experienced Scottsdale fatal accident lawyer that they can trust.

If you have any questions whatsoever about Arizona wrongful death law or personal injury cases, we welcome your phone call. At Breyer Law Offices, P.C., will tell you the strengths and weaknesses of the case, and we will also communicate to you the likelihood of a case settling early or going all the way through trial. We will give you all of the information we can possibly provide so that you can make the best decision for yourself and your family in terms of how to proceed with the case.

Scottsdale, Arizona Wrongful Death Attorneys

The term “wrongful death lawyer” is thrown around so much that it probably has very little meaning to the average person. A “wrongful death lawyer” is somebody who helps families who have lost a loved one in some type of incident that should have been prevented. The most common type of wrongful death occurs in a car accident. Therefore, many of the best Scottsdale car accident lawyers also handle Scottsdale wrongful death claims. Also, a wrongful death claim does not necessarily include a lawsuit. Many wrongful death cases end with a claim made against the insurance company for the negligent party.

A wrongful death basically relates to a situation where somebody died from unnatural causes that would not have occurred had somebody else not been negligent. Obviously, most often when people pass away it is not the result of a mistake made by somebody else. However, whether it be in a car accident, trucking accident, motorcycle accident, construction injury, or any other type of incident where somebody’s neglect and carelessness led to the death of somebody else, a wrongful death claim may be made.

However, deciding whether to hire a top Scottsdale wrongful death attorney is not an easy decision to make. It is apparent that many wrongful death attorneys talk only about the laws related to that particular case. It is our belief that families need to make very tough decisions before taking on a wrongful death action. Every family should consult with a lawyer that they can trust to help guide them through the process and communicate with them effectively before they take the plunge into the handling of a wrongful death case. Every family who is dealing with a wrongful death has already suffered a great deal. The best possible personal injury lawyer for any particular family is the one that can connect with that family honestly and fully and also has the experience and expertise to pursue that claim and receive full compensation.

Arizona’s Ongoing String of Pool Drowning Tragedies

As a certified specialist in injury and wrongful death law by the State Bar of Arizona, I am very familiar with people who have suffered tragedy. Many of my clients suffered life changing tragedies, and I helped the families of those who have lost loved ones as a result of unexpected traumatic events. However, the constant string of pool drownings throughout the State of Arizona, from Flagstaff down to Phoenix down to Tucson and across the entire state, is overwhelming.

According to published reports, drowning is the number one cause of accidental death among children Age 1 to 4 years old. In fact, according to at least one study, other than motor vehicle accidents, the leading cause of accidental death in children from Ages 1 to 14 years old is drowning.

Sometimes, of course, these numbers mean very little to the individual family who suffers such a tragedy. And, realistically, filing a lawsuit or hiring a personal injury lawyer is the last thing on somebody’s mind at the moment they first learn of a drowning death or near drowning tragedy. However, many families begin to consider their options at some point thereafter. Many families seek to have some justice and hope to provide a deterrent so that other kids will not suffer the same fate. However, those families deserve honest answers to both the strengths or potential weaknesses of any such claim. Those people deserve a no cost evaluation with a skilled Phoenix child swimming accident lawyer to decide what options they have and what their time deadlines may be in pursuing such a case.

If you or anybody you know is trying to decide whether or not they want to pursue a claim or, in the alternative, have decided to pursue a claim but want to speak to an experienced and reputable Arizona personal injury lawyer, please feel free to contact us at Breyer Law Offices, P.C. You can count on honest, straight forward advice that will allow you to make an informed decision that is in the best interest of you and you entire family.

When Negligence Causes Wrongful Death

When death comes as the result of a tragedy whose cause may be a level of carelessness that constitutes negligence on the part of another person the emotional toll can be profound. Many families spend years trying to reconcile the fact that the life of someone they loved might have been saved if a single contributing factor had been prevented. It’s a bewildering experience to pursue legal advice at a time when family adjustments and personal grieving should take precedence. You deserve time to stop and catch your breath.

We recognize that searching for a skilled AZ wrongful death lawyer is the last thing you want to do at such a difficult time. However, needs that can’t be avoided will soon present themselves without regard to the time it takes to grieve. Families must be conscious of the effects an unexpected loss will have on young children, teenagers, or elderly parents. Needs could include time away from school for students or an entirely different living situation for parents and relatives. And there’s the challenge of managing personal grief and helping other family members cope. A changing financial outlook, lost income, and the prospect of relocation are other possible effects. Life is truly turned upside down.

When these concerns threaten to overtake you, we’re here to help.

At Breyer Law Offices, P.C., we take pride in our efforts to relieve the pain of families who have suffered unspeakable tragedies. We not only believe that we are excellent at what we do, but we do the best possible job as wrongful death lawyers in Arizona. We continue to assist families in every part of the legal process to make sure that they get the opportunity for renewal in the wake of loss.

Finding the Right Lawyer for Your Wrongful Death Case

Unfortunately, there’s no formula for legal success if you’re a grieving family. The decision to retain a lawyer often feels like a necessity on one hand, and a chore on the other. The most important consideration is whether or not the one you pick is the right fit for your family.

Find out if the wrongful death attorney in Phoenix you want to hire has handled past wrongful death cases so that legal knowledge and experience will never be in question. We believe it is far too easy to mislead a grieving family into believing they should bring a claim when no claim is warranted, and that’s a mistake. Use your instincts. Is the advice you’re getting honest and straightforward?

Families who have suffered a wrongful death must be able to trust that they’re getting completely honest answers – good or bad – from the attorney they consult. When the answers you’re getting make sense and present a clear view of the legal process to come, you’ve found the right attorney to hire. You need to know that your attorney can ably assist your family to resolve all affairs following an untimely death.

Though we offer exactly that, it’s also important to point out that even the best wrongful death lawyers in the country are specialists; the scope their expertise is mostly limited to personal injury law. Unfortunately, a personal injury lawyer in Arizona cannot handle child custody issues. Nor is your personal injury lawyer the best person for estate planning or the rewriting of a will. But an outstanding wrongful death attorney in Arizona will advise the grieving family to help locate the right people to assist in those essential capacities.

We find helping people very rewarding, and we take great pride in our efforts to ease the pain of families who have suffered unspeakable tragedies. At Breyer Law Offices, P.C., not only do we believe that we are excellent at what we do, but we do the best possible job as Phoenix wrongful death attorneys. We continue to aid families in every part of the legal process to ensure that they get the chance for renewal in the wake of loss. Please feel free to contact us for a free, no-obligation evaluation of your wrongful death case.

A Wrongful Death Attorney Can Help You

In many cases we’ve seen, the potential client is aware they need to hire a lawyer. They’re aware that tragedy was brought on by the reckless behavior of another party or parties. They already have questions that only a lawyer should answer. Finally, many potential clients are all too aware that they’ll need serious compensation to overcome the financial void created in the wake of their unfortunate loss.

The knowledge that money cannot undo a painful tragedy often makes people think finding a lawyer is not vitally important. Money can never change our feelings; that’s a claim no one would support. What’s imperative is that potential defendants in wrongful death lawsuits limit the harm they suffer, whether financial or emotional.

Premature loss of life creates needs that never before existed. When one parent can no longer contribute earnings, a reasonable mortgage payment becomes a monthly challenge. Cost should not prohibit a family’s option to give a child dealing with the loss of a parent the option of professional grief counseling and a healthy recovery. Adults who have lost a spouse or a child deserve the best mental health care available—an option that’s not always provided by employer-based health plans.
There are so many other concerns as well. Will your lawyer give you an honest opinion if the case isn’t strong? Does he have the experience to gain the maximum compensation possible in your case? Will she be sensitive to the family’s wishes? It’s a trying time. Will he know if pursuing a lawsuit is really in our best interests?

At Breyer Law Offices, P.C., we take pride in our efforts to relieve the pain of families who have suffered unspeakable tragedies. We not only believe that we are excellent at what we do, but we do the best possible job as wrongful death lawyers in Arizona. We continue to assist families in every part of the legal process to make sure that they get the opportunity for renewal in the wake of loss. Contact us today to learn more about how we can help.
