A pedestrian was killed in a Glendale car accident after being struck by an out-of-control car. According to a news report in The Arizona Republic, the fatal pedestrian accident in Glendaleoccurred near the intersection of 59th and Olive avenues. The vehicle involved in the crash crossed over from the northbound lanes across the southbound lanes and onto the sidewalk before striking the pedestrian. The pedestrian died at a nearby hospital and two people in the car were also hospitalized. It is unclear what caused the crash or if the driver will be cited for the fatal collision.
Under Arizona Statute 28-904: “A person shall not drive a vehicle on a sidewalk area except on a permanent or duly authorized temporary driveway.” Whenever a driver goes off a roadway it must be determined what caused the driver to lose control. Was the driver speeding or driving distracted? Was the motorist under the influence of alcohol at the time of the crash? Did the driver suffer a medical condition? Was speed a factor in the crash?
In cases where negligence or wrongdoing is involved, the family of a deceased pedestrian accident victim can file what is known as a wrongful death claim. Such a claim usually seeks compensation for medical and funeral expenses, lost future income and benefits and emotional distress.
