A 17-year-old teenage girl has been critically injured in a Phoenix pedestrian accident. The young victim was walking on Broadway Road in Phoenix, when a car making a turn struck her. The teenager suffered a severe head injury and has been listed in critical condition.
According to the Arizona Department of Transportation’s 2009 statistics, 190 people were injured in Arizona pedestrian accidents. Of those, four victims were teens between the ages of 15 and 19. Also, during the same year, 122 pedestrians were killed and 1,304 were injured in Arizona.
Drivers do not have to be cited for a car accident to be held civilly liable for the damages. A victim must only prove that the driver’s negligence contributed to the collision. Proving that the driver was unable to avoid the collision because of distracted driving or speeding can be sufficient in a civil claim.
Determining fault and liability is critical in Arizona personal injury claims. Injured victims can seek compensation for medical expenses, loss of earnings, cost of hospitalization, rehabilitation and related damages. If a pedestrian accident was caused by a dangerous roadway or intersection, the government agency responsible for maintaining that roadway can also be held liable.
