Woman in Wheelchair Killed in Phoenix Pedestrian Accident

A 56-year-old woman in a wheelchair was recently killed in a Phoenix car accident, AZfamily.com reports. According to the article, the pedestrian accident occurred on 7th Street near Vogel Road in Phoenix when the woman was fatally struck by a Dodge pickup truck. She died at the scene of the crash. It is unclear if the 42-year-old driver of the truck will be cited for the accident.

According to the Arizona Department of Transportation, 122 pedestrians were killed and 1,245 were injured in 1,523 pedestrian accidents statewide in 2009. Many pedestrian accidents are caused by negligent drivers or dangerous roadway conditions. Whenever someone is killed in an Arizona pedestrian accident, investigators will try to determine how the crash occurred and who was responsible for the collision. In cases where it is determined that driver negligence was a factor, the family of a deceased accident victim may hold the driver civilly liable for the victim’s wrongful death.

An Arizona wrongful death claim is a civil lawsuit that allows a deceased victim’s family to pursue compensation for their loss. Compensation may be available for medical expenses, funeral bills, lost future wages, and pain and suffering. Anyone who has suffered a loss in an accident would be well-advised to speak with a skilled wrongful death attorney regarding their legal options.

The experienced Phoenix personal injury lawyers at The Breyer Law Offices, P.C. are here to answer any questions you may have regarding your potential personal injury or wrongful death claim. Call us at 602-978-6400 for a free and comprehensive consultation.

Arizona Bus Crash Near Hoover Dam Kills And Injures Tourists

The National Transportation Safety Board reported that the bus accident that took the lives of a number of Chinese tourists may have been the bus driver’s fault. There was initial speculation that there may have been something wrong with the door, which distracted the driver, and that “sun glare” also might have blinded the bus driver prior to him losing control. Preliminary investigation found nothing wrong with the door nor did they find any other mechanical problem.

These Chinese tourists were likely enjoying a wonderful occasion and vacation before their bus crashed. It is tragic and extremely unfortunate that lives had to be lost and it is probable that the families of the Chinese tourists involved in this wrongful death accident are unaware of what can be done in terms of seeking compensation for lost wages and other expenses.

As Arizona wrongful death attorneys and personal injury lawyers, we understand that though this case probably does not involve seeking “punitive damages,” the filing of a lawsuit in this situation may very well increase safety for people and perhaps prevent future bus accidents. Since companies are usually in the business to make a profit, the likelihood that the bus company will take safety precautions increases if they are forced to face a lawsuit and they are unlikely to take such measures if there is no threat to their bottom line.

Lives are saved through personal injury lawsuits. Assuming that what happened to this tour bus was preventable, had DW Tour and Charter of San Gabriel, California been exposed to previous lawsuits, they would have been more diligent about safety issues. It is unfortunate but sometimes necessary that companies be threatened with loss of profits in order to safeguard the lives and preclude serious injuries to innocent people.

Should anyone have questions about this bus accident or another serious bus accident, we invite those people to contact us at Breyer Law Offices, P.C. It is necessary that injured parties retain a lawyer from the state in which an accident occurred, or in this case perhaps the state in which the defendant is located, in order for negligent parties to be held responsible for the damages caused.

Chandler Arizona Motorcycle Crash Kills Woman

A 30-year-old woman from Eloy died after a motorcycle accident in Arizona on Interstate 10, when the driver on the Harley Davidson on which she was riding struck a tarp that, according to reports, then became ensnared in the rear wheel of the motorcycle. Motorcycle accidents and car accidents are too often caused by the negligence of those who dump trash or other debris on the freeway.

We have no idea from where the tarp came or how it ended up on the freeway, but to the family of the woman who died in this motorcycle crash it makes no difference.

Financial considerations after the loss of a loved one may not seem so important to some people, yet often the loss of a family member brings on dire economic hardships for the surviving family members. Too often we find as experienced personal injury attorneys that the family depended on the income the lost family member provided.

From what has been said in the news, we cannot determine if the tarp was left on the freeway negligently, but we do know that it should be investigated. Debris on roadways causes unnecessary deaths to motorcyclists in Arizona every year.

Not every motorcycle or other motor vehicle accident requires a lawsuit, but an honest and skilled Chandler motorcycle accident attorney will answer questions that will allow people to make the best decision for their families. It is not so much about whether a lawsuit should be filed in response to a motorcycle crash in Arizona like this, but so that the survivors of such tragedies can go on with their lives with as little additional hardship as possible.

An experienced personal injury lawyer can answer questions for someone who has been in a motorcycle accident such as this one. This is why we encourage people to contact us if they have been in any kind of a motor vehicle accident.

Phoenix Truck Accident Leaves 9 Year Old Dead

Our sympathy goes out to the family of a nine-year-old boy struck by a pickup truck on a busy street in West Phoenix before the school bus had come to pick him up. Reports say he died later that morning at the hospital. It is always sad to hear about the death of a child.

People often ask us why we pursue personal injury claims in Arizona in cases like these, as money certainly cannot nullify such a loss.

We have put a lot of thought into this issue, and know that money can never take back what has been done. Yet, there are financial implications when a child is lost. If the child’s death is even partially the result of a driver’s negligence, why should a negligent driver not be penalized? The same goes for the insurance company that covers a negligent driver. It is not a question of undoing the damage to the family in cases like these, but lessening the financial impact upon the surviving members of the family.

All sorts of questions, including whether or not the family should pursue a wrongful death claim, follow tragic fatal truck accidents in Phoenix and other personal injury accidents like these. However, even though the law may permit a wrongful death claim to be pursued does not necessarily mean it should be. It is not the law, but instead the family’s unique situation that should be taken into account, even if another party’s negligence or neglect caused the death of an innocent victim. Filing a lawsuit is not the best decision for everybody. This being said, others who have suffered the tragic loss of a child want justice. They want someone to be held accountable. They want to know the loss of the child was not in vain. They want someone to say in open court that the life of the child that was lost had value, and that he or she was important. For some people, not filing a wrongful death claim will leave the family even more unfulfilled if there is no measure of justice for their loss.

We never try to convince a family to file a wrongful death lawsuit unless it was in their best interests, even though we are experienced Phoenix Arizona wrongful death attorneys. As practiced and certified specialists in injury and wrongful death, we understand the emotional process parents go through when they lose a child, and feel they should speak with a veteran lawyer who will not try to persuade them, but who will actively answer their questions so that they can decide what is right for them. Nothing can bring back this nine-year-old boy, or any other child who dies in an accident in Arizona or elsewhere. We should not, however, judge those who pursue their rights under the law.
