Woman in Serious Condition after Phoenix Pedestrian Accident

Recently, a 20-year-old woman was seriously injured in a pedestrian accident when a vehicle struck her at a bus stop near 23rd Avenue and Thomas Road in Phoenix, according to a news report in The Arizona Republic. Authorities report that the vehicle went off the road and struck her. She sustained life-threatening injuries and has been listed in very serious condition. It is unclear why the vehicle left the roadway or whether the driver will be cited for the Phoenix pedestrian injury collision.

The Arizona Department of Transportation reported 122 pedestrian fatalities and 1,304 pedestrian injuries in Arizona during 2009. During that same year, 157 people were killed and 15,129 were injured in pedestrian accidents in Phoenix. Arizona Statute 28-904 states: “A person shall not drive a vehicle on a sidewalk area except on a permanent or duly authorized temporary driveway.” Any motorist who fails to do so may be held liable for any accidents or injuries they cause.

In any accident where negligence or wrongdoing is a factor, injured victims can seek compensation by filing a personal injury claim. Injured victims can seek compensation for medical expenses, lost earnings, cost of hospitalization, surgeries, rehabilitative treatments, and even long-term care.

How Does an Injury Victim Know When to File a Claim?

Even handling the initial aspects of a car accident or other personal injury case can put a person at significant risk. Many cases do not require that someone hire a Phoenix personal injury lawyer urgently and in these cases, a person can wait months without negatively affecting the claim, but with some cases immediate action is necessary. It usually takes an experienced attorney to determine whether a personal injury claim requires immediate attention, however. As recovery of damages in any Chandler personal injury claim can only happen once, and to avoid the risk losing your right to compensation altogether, it is best to at least consult with a trusted Chandler personal injury attorney. We know that not every personal injury claim requires that a person hire an attorney immediately.

Yet what is the timeframe in which someone injured in a Chandler car accident or other accident resulting in injury has to hire a lawyer and file a claim? This depends on the statute of limitations in the case, which may vary widely depending on the specifics of the personal injury claim. In such cases, a professional attorney will not only advise an injured party as to the best course of action but also protect the rights of an injured party.

If you are wondering whether or not you require the assistance of an attorney for your personal injury case in Arizona, please feel free to contact Breyer Law Offices, P.C. We offer free, no-obligation consultations and may be able to clear up any uncertainties you may have. Contact us today.

The Question of Proof in Cell Phone Peoria Car Accidents

As Phoenix personal injury attorneys, we fully understand that not every valid case must be pursued if it’s not truly going to benefit the person who was injured. Some accident victims just want honest answers to their questions so they can make the decision as to whether to pursue a claim. Sometimes, contacting the best lawyer does not necessarily mean a person wants to make an insurance claim or file a lawsuit, only that the person want to know what options are available. We are always here to answers those questions, no matter the situation.

When accidents are caused by negligent drivers who are talking on cell phones or sending text messages, other issues are created. Primarily there is the question of proof. How can one prove that the other driver in the accident was on a cell phone? How can one show that the other driver was sending text messages? Just because someone is driving while chatting on a cell phone, does that mean he or she was negligent? Getting the cell phone records is an important first step in attempting to prove crucial parts of your case. How can one gain access to another person’s cell phone records? Usually it requires a lawsuit and a subpoena.

Underinsured Motorist Coverage in Peoria Car Accidents

Underinsured motorist coverage is called upon more frequently than uninsured coverage when the injuries suffered in an auto accident are more serious. Let’s say a driver causes a serious injury that requires a substantial amount of costly medical treatment. Phoenix personal injury lawyers have seen first-hand how medical costs can be so great in some cases that the at-fault party’s insurance does not even cover the hospital bills. And if the policy cannot even cover those expenses, it is unlikely to sufficiently reimburse past and future lost wages, rehabilitation, or other expenses that are allowed by law. In these cases, uninsured motorist coverage claims are made.

An uninsured motorist claim allows an injured motorist to turn to her own insurance policy (or a family member or other loved one’s policy, which may also cover the motorist even if she did not pay for the policy herself) to defray medical expenses, pain, frustration, and all the lost wages and other losses left over when the other driver’s insurance policy limit has been reached. So if the person at fault had a $100,000 insurance policy and the injured party incurs $80,000 in medical bills, the injury victim’s medical bills alone nearly exhaust the entire policy. If the claim includes damages for pain and suffering or ongoing rehabilitation costs, the person who caused the accident does not have enough insurance to cover the entire claim.

In this case, the injured party would be very interested to find out that she has taken out an underinsured motorist coverage policy. If her policy provides an extra payment in this circumstance, she could claim the money that should have been otherwise paid out by the at-fault driver’s insurance, had it been sufficient.

What Should I Say to the Other Driver’s Insurance Company if They Call Me?

Simply say, “Thank you for calling but I am not prepared to discuss this matter with you at this time.” Never, ever give a statement to the other driver’s insurance company. Claims adjusters are trained to use psychological techniques in order to elicit certain information from you – information that may come back to haunt you later.

Medical Payments (Med-Pay) Coverage

Medical payments coverage is a type of health coverage also known as “med-pay,” “personal injury protection (PIP),” or “economic loss protection benefits.” This coverage is meant to take care of practical expenditures brought on by needed medical and funeral services due to bodily injury resulting from an accident.

This kind of insurance is not required by Arizona law and only covers the insured driver and any passengers in the insured driver’s vehicle.

So, for instance, if a negligent driver injures you in a car accident, the other driver’s insurance company will not pay med-pay or PIP benefits. Only your own insurance policy can pay out these types of benefits to you.

There is a lot to think about after being involved in an auto accident in Arizona. If you’ve suffered injuries and believe that a negligent driver caused the accident, you may be able to seek compensation to help pay for expenses associated with your injuries and any property damage.
