Can I File a Personal Injury Claim if I Was Injured on a Construction Site?

Did you know that construction is actually one of the most dangerous job on the planet. On a daily basis, construction workers face the risk of injury on the work site. And as Maricopa County continues to grow and expand, there are more and more construction sites that seem to be appearing all over the place. In many of these cases, construction workers think that their only recourse is to file a workers’ compensation claim. But that’s not true. You may be able to file a personal injury claim in addition to a workers’ compensation claim.

And the compensation awarded in personal injury claims is in addition to – not a substitute for – workers’ compensation. In other words, you won’t be forfeiting any money you receive from workers’ compensation by filing a personal injury claim.

In terms of what kinds of construction accidents can lead to claims, there aren’t any rules or laws. We’ve seen many different types of accidents that have resulted in personal injury claims. These include injuries caused by collapsing ceilings, floors, or walls, falls from scaffolding, injuries due to electrical problems, accidents caused by large equipment, crane accidents, trench accidents, and falling equipment.

Even when everyone follows the letter of the law and does their job right, accidents do happen. Obviously in these kinds of cases, there probably isn’t a valid personal injury claim and workers’ compensation must be relied on for compensation. However, many construction accidents in Maricopa County are caused by negligence on the part of another person or a company. The person may have intentionally ignored an OSHA regulation or they may have cut corners in order to save money or meet a tight deadline. Whatever the reason, the people who caused the accident and subsequent injuries should be held accountable. Filing a personal injury claim will help to punish the responsible party and also send a message that negligent behavior on a construction site is unacceptable.
