What Are the Rights of Passengers in Car Accidents in Phoenix, Tucson, and Throughout the State of Arizona?
Passengers often do not realize that they have a different set of rights than the drivers of vehicles. Since it is extremely rare to have an accident that is blamed on a passenger, they are not necessarily "tied to" the driver of the vehicle that they were in. For instance, many Arizona car accidents are caused by the negligence of more than one person. Therefore, the passenger in one vehicle may have been injured as a result of the negligence completely on the driver of a separate vehicle. Or, perhaps, the driver of the vehicle that they were in caused the accident.
However, many passengers assume that if the driver of the vehicle that they were riding in was negligent that they have no Arizona auto accident claim that can be made. This is simply not the case. Since the passenger is almost never at fault for the accident, they have a right to make a claim against both people (usually, both insurance companies) to make sure they are fully compensated for their loss. Even though they know the person they were riding with, and they may well be a close friend or family member, this does not prevent them from obtaining fair compensation for the insurance company – regardless of which driver is at fault.
