MARK BREYER RECEIVES HIGHEST POSSIBLE LEGAL DISTINCTION
Martindale-Hubbell, a renowned lawyer resource for more than 100 years, has awarded Attorney Mark Breyer its highest distinction for practicing lawyers. Mark is an injury and wrongful death attorney and has worked exclusively in this area of the law since 1996. He is also a certified specialist in injury and wrongful death law by the State Bar of Arizona. Mark joins the prestigious group of attorneys throughout the country who have received the highest ranking (called "AV") by Martindale-Hubbell. To receive the highest rating Martindale-Hubbell examines an attorney's legal abilities and ethical compliance.
There are two different criteria upon which Martindale-Hubbell's peer review rankings are based. First, lawyers can achieve a rating based upon their ethical standards. Lawyers who are considered to adhere to the highest professional standards of conduct in relation to ethics, reliability, diligence, and other criteria in the discharge of legal services can be awarded a "V" for very high ethical standards. There is no ethical award higher than the "V" rating.
In addition, the legal ability of lawyers is rated. There are three levels of legal ability ratings that have been established by Martindale-Hubbell and awarded to those lawyers that earn them. Each of these ratings is an accomplishment in its own right but the highest ranking is the most prestigious. The highest possible Award by Martindale-Hubbell in peer review rankings for the legal abilities of lawyers throughout the United States is the "A" ranking. This ranking is reserved for lawyers who are considered to have demonstrated a "very high to preeminent" status.
Not surprisingly, when asked about this achievement, Mark Breyer indicated he was extremely pleased when he learned of this ranking. "I am thrilled to have been awarded the "AV" rating by Martindale-Hubbell. However, I believe this is a ranking of far more than just for my accomplishments that I have had as a personal injury lawyer. This AV ranking is a testament first and foremost to my wife, Alexis Breyer, and the rest of our staff. When we founded our injury and wrongful death practice, which has come to be known throughout Arizona as "The Husband and Wife Law Team" we hoped that we could combine a caring environment and commitment to our clients that would be expected of a husband and wife running a law office. At the same time, we strived to achieve fantastic results and earn the respect at the highest possible level from judges, lawyers, and the Arizona legal community. This is another sign to Alexis, myself, and our staff that we have been able to achieve both of these goals. I'd like to thank Martindale-Hubbell for bestowing this honor."
Mr. Breyer also indicated he would remain accessible and available to all those involved in serious injury or wrongful death matters in Arizona. He mentioned that his practice has grown through referrals of former clients and other lawyers and these types of achievements will not change the commitment Alexis Breyer and he share towards helping those who have suffered injuries throughout Arizona. Those who would like to speak to Mr. Breyer directly can contact him by calling 602-267-1280. Breyer Law Offices has locations Valleywide and throughout the State of Arizona. Arizona Injury Victims, Represented by "Arizona's Husband & Wife Law Team" Get Their Day In Court and a Win From The Jury After Much Delay By The Insurance Company
After delay, delay, and more delay, injury victims finally receive jury verdict in their favor, against insurance company's driver
On August 29, 2005 Christie Webb and Darryl Webb were travelling down the I-17 when they were rear-ended by another driver. It took almost four full years, but a jury has just entered a verdict in their favor. Although most cases do not take this long to get to jury trial, for those cases that do take longer to resolve, it is the clients and lawyers determination must be applauded. This case is not just an example of two people willing to fight through long delays that only benefit insurance companies at the expense of real people. This case is also an example of clients who were willing to hold-on as long as needed for justice with lawyers at their side willing to fight as well for as long as it took to win. It is unfortunate that the system can allow such extreme delay, but this verdict stands as a reminder of the importance a good legal team still plays for the injured in Arizona.
In this case, the defendant driver rear-ended Mr. and Mrs. Webb's vehicle. Instead of readily admitting to fault, the driver tried to pay bystanders to testify that he was cut off by a phantom vehicle. The bystanders told police that the Defendant tried to bribe them with money to give him an alibi. Did the jury ever hear these facts? No. In Arizona, if a Defendant admits to liability the law usually allows an at-fault Defendant to keep these damning facts from the jury. Even without this evidence, the jury gave the Webbs their long sought-after victory. Sure, awaiting a day in court can be tough, but the Webbs were happy and it was all worth it in the end.
One of the most interesting parts of the trial occurred when one of the jurors questioned the Judge as to why it took so long to get the case in front of a jury. The Judge could not answer this juror's questions as Arizona rules of evidence do not allow the Judge to answer this type of question regarding Arizona's legal system. Attorney Mark Breyer, the renowned Phoenix personal injury lawyer, was asked about this unusual moment in this case. He explained, "The Judge made the right decision in not answering the question. Not because the question is unimportant, but the rules of evidence do not allow the jury to hear the truth. The truth is that delay is almost always to the benefit of insurance companies, because many innocently injured people that we represent at Breyer Law Offices simply quit fighting and are unwilling to take a case to trial after such a long wait. These clients should be commended not just for receiving the verdict in their favor, but in being willing to continue to fight for what was right. Most cases simply do not take this long. When they do, it is a great feeling to be able to see justice done."
What extreme will defendants in personal injury cases go to in order to avoid paying the compensation required under Arizona personal injury law? According to attorney Alexis Breyer, the wife in "Arizona's Husband and Wife Law Team" that represented the Webb family, "The case originally was arbitrated in front of an impartial party where an award came down for the Plaintiffs as well. Rather than paying that award the insurance company chose to appeal it and go to trial. It took 2 years to get to a jury trial where again there was a finding for the Plaintiffs. The law gives the insurance company an opportunity to appeal yet again and further avoid payment. In sticking by our clients we will continue to fight for justice."
For their part, although it was a long wait, Mr. and Mrs. Webb are very happy with the verdict. They certainly earned it.

It is no secret that the economy is suffering and public education may take the biggest hit of all. While hard-working people are getting laid off and struggling to pay their bills, teachers do not have enough money in the budget, in some districts, to even have paper to use for teaching materials. To offer a little deviation from this bleak economic and educational outlook, one law firm is offering a free contest to get some money to a teacher and an Arizona family, as well as to give one lucky class a pizza party to end the school year.
Although Alexis and Mark Breyer of Breyer Law Offices, known throughout Arizona as "The Husband and Wife Law Team, created this unique, fun contest. All entries will be put in a hat on May 1, 2009 and a winner will be chosen. The deadline to enter is April 30, 2009. The person who submitted the winning entry will receive $250.00 for nominating the teacher, the teacher will receive $250.00 that can be used for any purpose, including the purchase of much needed education materials, and Breyer Law Offices will throw a pizza party for that child's classroom (up to $50 worth of pizza) during the last couple weeks of the school year. New Book Details the Truth about Insurance Companies and How They Can Take Advantage of Innocent Injury Victims
What happens to individuals who are killed or seriously injured by drunk drivers, reckless drivers, or other dangerous behaviors?
Nationally, hundreds of thousands of people are injured each year in preventable accidents. The National Center for Statistics and Analysis reports that over 41,000 people were killed in car accidents in 2007. In Arizona, there were over 1,000 fatal crashes in 2007. These figures do not take into account the far greater number of innocent people hurt by drunk drivers or negligent drivers, the more than 1 million injuries caused by dog bites each year accorded to the Center for Disease Control, or the thousands of construction workers who suffer injuries each year due to construction site violations according to the U.S. Bureau of Statistics.
In spite of these overwhelming statistics, the general public's perception of a "litigation crisis" has allowed the insurance industry to take advantage of the injured. Injury victims do not know the laws, and most do not even think about the legal system until a significant period of time after the tragic accident as they are focusing on getting better or going through the healing process of losing a loved one. Meanwhile, during these early months, the injured individual in many cases is missing deadlines that will steal away their rights as many of the laws that have been created favor the at- fault party.
Alexis and Mark Breyer, Arizona personal injury attorneys, wrote a first of its kind book, "The 13 Biggest Mistakes that can Destroy Your Arizona Injury Case: The Master Guide to Arizona Injury Claims" after repeatedly witnessing victims of an accident being victimized a second time by our system. "We saw a need to educate victims and their families. When honest, hard working Arizonans cannot receive reimbursement for their medical bills or lost time from work, someone needs to step forward and help people realize how the insurance companies and even their own government are denying fair compensation to innocent victims." said attorney and co-author Mark Breyer. According to Alexis Breyer, "It is time that the individuals, companies, corporations, and governments who act recklessly and negligently accept the same personal responsibility and accountability that the average citizen must accept."
Both Alexis and Mark Breyer stated they felt they needed to write this book to finally help bring a level playing field to the people who must seek deserved compensation from corporations, insurance companies, and the government. "From the trucking company that encourages its drivers to drive in excess of the government regulations to the city employee that admits to being at fault for an auto accident yet uses little-known laws to escape responsibility, the time for everyone to accept responsibility for their own actions has finally come. The person responsible for an injury should not be allowed to walk away from their actions without consequence, while the innocent victim is in a hospital bed unable to pay the mortgage and help his family."
The Master Guide is the most valuable tool an injury victim could ask for in the awful event that they are hurt by someone else's negligence. It is comprehensive - a real 'nuts and bolts' look at the legal process from beginning to end. The book is in plain English and discusses the legal process for injury claims; gives tips on dealing with insurance companies; offers insight into how claims are valued; and discusses common questions and legal issues that are often present in injury cases. Most importantly, the book discusses common pitfalls, traps to avoid, how our jury system works, and the laws, that if not known, can devastate an injured individual's case.
The book is published by Word Association Press and is available for $15.95 at Amazon.com. As a public service to citizens in the state of Arizona, a person can order a free copy of the book by visiting www.ArizonaInjuryBook.com.
