Scottsdale Slip & Fall Accident Lawyers

Slip & Fall Attorneys

Whether it is a slip and fall or a trip and fall that happens to a Scottsdale resident or within the city limits of Scottsdale, Arizona, these types of cases are known as "premise liability" cases. Under Arizona law, a property owner is not automatically responsible for any injury that happens on their property. This is one of the biggest misconceptions when it comes to personal injury law. As a personal injury law firm that spends a great deal of time answering questions to people who have been seriously injured, we have come to recognize that this is one of the areas of law that is the least understood. Most people are of the belief that if they get hurt at a store or at somebody else's house, the owners of the store or of the home are legally responsible.

Arizona law does not work in this way. Under Arizona premises liability law, the owner or possessor of property is only liable if they knew or should have known of an unreasonably dangerous condition. In the situation where that property owner or the person occupying the property knew or should have known of an unreasonably dangerous condition that causes an injury, they may well be held responsible under the law.

However, trying to prove whether or not a condition is unreasonably dangerous, and even more so trying to prove whether or not an owner had knowledge or should have had knowledge of that condition, can be extremely difficult.

Certainly, not every serious personal injury or wrongful death case necessarily requires the help of an experienced injury lawyer. While this is often the case, it is not always true. On the other hand, when it comes to slip-and-fall cases in Arizona and trip-and-fall cases in Arizona, the law makes it so difficult to pursue and collect these claims without a lawyer and we believe somebody who has been injured in this way should almost always try to contact a lawyer they feel they can trust.
