What To Know About Switching Injury Lawyers in Phoenix
Can You Switch Injury Lawyers in Phoenix?
Interestingly enough, we receive many calls from people who have been involved in Arizona car accidents and want to switch lawyers. Many people call our office to ask whether they can switch to our office because they are very unhappy with the lawyer that they hired. People tend to be unhappy with their attorney for the following reasons:
- The lawyer does not call them back
- The lawyer does not communicate with them
- They never receive phone calls from the lawyer about their case
- The lawyer does not talk to them respectfully
- They do not feel that the lawyer is doing any work on their case
- The lawyer does not show that they are aggressive
- The lawyer does not appear to be processing their case at all
What Do You Do When You Want to Switch Injury Lawyers?
If you want to switch injury lawyers, the good news is that you do have a choice. It is important to keep a copy of your contingency fee agreement that you have signed. Typically, the contingency fee agreement will say that you are allowed to switch attorneys at any time. Even if the contingency fee agreement does not say this outright, under Arizona law you are not held to any one attorney. If you do not feel that your current attorney is doing a good job, you are allowed to hire another lawyer. We always recommend that you have a discussion with your attorney if you feel that you want to leave the attorney for lack of communication. Many attorneys do not put client communication as a priority but they are actually doing a good job on your injury case. We have seen this many times before. If you talk to your attorney and are still unhappy, we recommend that you call another Phoenix personal injury attorney for a second opinion.
Do You Have to Pay Your First Injury Attorney?
Whether or not you have to pay your first attorney if you decide to switch attorneys, is something that your first attorney and second attorney will work out together. Whatever the percentage fee, the two attorneys will work together to split up that percentage. You are not charged twice. If you were charged twice, this would forbid you from switching attorneys. For a contingency fee agreement, you only pay the one percentage and then the old attorney and new injury lawyer decide what amount each attorney should get. It is important not to leave your attorney until you do talk to a second attorney. You want to make sure that another injury lawyer will take on your case before you just leave your original injury lawyer.
