What Is Wrongful Death?

Wrongful death is a legal term denoting a civil action in which damages are sought against a party for causing a death. This type of lawsuit is brought by surviving family members against individuals or entities who knowingly or negligently caused the death of a person.

A wrongful death lawsuit is separate and distinct from any criminal charges, although there may be criminal prosecution related to the fatality in some cases.
