What Are the Main Causes of Wrongful Death?

Although wrongful death may be caused by intentional violence, it most frequently results from accidents caused by negligence. Common causes include:

  • Car accidents: Motor vehicle collisions are a leading cause of death in the U.S. An estimated 42,795 individuals died in traffic crashes in a recent year, as reported by the National Highway Traffic Safety Administration (NHTSA). Drivers may be held liable for fatal car accidents caused by negligence.
  • Motorcycle accidents: Per vehicle miles traveled, the number of deaths on motorcycles in the U.S. in 2021 was nearly 24 times the number in cars, as reported by the Insurance Institute for Highway Safety (IIHS). Many motorcycle wrecks are caused by the negligence of other drivers who violate the rider’s right of way.
  • Truck accidents: In a collision between a passenger vehicle and a semi-tractor-trailer, occupants of the much smaller vehicle are likely to suffer catastrophic or fatal injuries. Who Is Entitled to File a Wrongful Death Claim in Chandler?

In Arizona, a wrongful death claim may be filed by a surviving spouse, child, parent, or guardian of the deceased victim or by the personal representative of the estate on behalf of surviving family members.

The statute of limitations for wrongful death claims is two years from the date of death. A lawsuit must be filed within that time period or be forever barred.
