What Does the Term “Wrongful Death” Mean?

Wrongful death constitutes when someone is killed through the negligence or misconduct of another. Family members of the deceased victim are entitled to file a lawsuit against the responsible party in civil court. What Types of Incidents Can Result in Wrongful Death?

Although wrongful death may be caused by criminal acts such as assault, robbery, or murder, it is most often the result of accidents caused by negligence. These include:

  • Car accidents: In Arizona, 1,180 crash deaths occurred in 2021, according to the Insurance Institute for Highway Safety (IIHS). When car accidents are fatal, at-fault drivers may be held accountable.
  • Pedestrian accidents: 7,508 pedestrians in the U.S. were killed in traffic crashes in 2022, as reported by the Governors Highway Safety Association (GHSA). Drivers in Arizona are required to yield to pedestrians. They may be held liable for wrongful death when they fail to do so and a pedestrian dies as a result.
  • Truck accidents: A collision with an 80,000 lb. fully loaded 18-wheeler can be deadly for passenger vehicle occupants. Truckers and the companies that employ them may be held accountable when their negligence results in fatal truck accidents.
  • Motorcycle accidents: A collision between a passenger vehicle and a motorcycle is much more likely to be fatal for the rider. Negligent drivers who cause motorcycle accidents may be held liable for their actions in wrongful death claims.

Who Can File a Wrongful Death Claim in Flagstaff?

Only certain surviving family members of the deceased or the personal representative of the victim’s estate are allowed to file a wrongful death claim in Arizona. Eligible family members are the surviving spouse, children, or parents or guardians of the deceased.

The personal representative may file on behalf of surviving family members. A wrongful death claim must be filed within two years of the date of death, after which the statute of limitations expires and the case is forever barred.
