Wrongful death constitutes when someone is killed through the negligence or misconduct of another. Family members of the deceased victim are entitled to file a lawsuit against the responsible party in civil court. Although there may be criminal prosecution, for example, when a drunk driver causes a fatal car accident, the civil action is separate and distinct from any criminal charges.
