What Does the Term “Wrongful Death” Mean?

Wrongful death constitutes when someone is killed through the negligence or misconduct of another.   • Car accidents: In Arizona, 1,180 crash deaths occurred in 2021, according to the Insurance Institute for Highway Safety (IIHS). When car accidents are fatal, at-fault drivers may be held accountable.

Who Can File a Wrongful Death Claim in Flagstaff?

Only certain surviving family members of the deceased or the personal representative of the victim’s estate are allowed to file a wrongful death claim in Arizona. Eligible family members are the surviving spouse, children, or parents or guardians of the deceased.

The personal representative may file on behalf of surviving family members. A wrongful death claim must be filed within two years of the date of death, after which the statute of limitations expires and the case is forever barred.
